Outline of the new Mexican Data Protection Law
Summary
On 5 July 2010, the Mexican Ministry of the Interior published the Mexican Federal Law for the Protection of Personal Data in Control of Private Persons (the Data Protection Law or the Law), which came in force on 6 July 2010.
This Data Protection Law is Mexico's first law of its type at the federal level and creates a new set of obligations and compliance challenges for companies that collect, process, store or manage Personal Data (as defined below) in Mexico.
Although the Data Protection Law came into force on 6 July 2010, some of its effects are set to be implemented at later times, including, among others, the publication of regulations, certain requirements for data collectors and the ability of data subjects to request correction of their data.
This document aims to highlight some of the main aspects of the Law and its effects for general guidance purposes. However, it does not reflect all obligations which exist or could be applicable under the Law.
